nennt es die eu kommission. schön. versehen mit dem vermerk: KOM (2002) 92 endgültig. wunschtraum oder war´s das jetzt?? ... " Als Kernvoraussetzung müssen diese aber den "Stand der Technik" in ihrem Gebiet so erweitern, dass der Beitrag "für eine fachkundige Person nicht nahe liegend ist" (heise) und damit beruhigt man softwarepatentgegner?? ist allgemeingut im patentrecht, hab ich gedacht. zumindets habe ich den satz in den letzten wochen so oft gehört, dass ich ihn gar nicht mehr hören kann. und was heißt "nicht naheliegend" für einen prüfer?? steht nicht in der patentdatenbank?? erstaunlich. im eu-papier steht, die rechtlsage war diffus ..., hola, hombres, wohl eher die handhabe. it´s a shame das matrix diese woche entfällt, aber so is einmal. und ich arbeite wohl irgendwie ins blaue hinein. vorproduktionen sind zum kotzen. manchmal. woher kommt eigentlich der ausdruck patente kerle??? an neu und erfinderisch kann es wohl nicht liegen ...

it´s not so easy to get clear answers on software patents, that´s for sure. manny schecter, ibm, on open source: "both have their value in their area, i don´t really want to comment on that."

therefore here is the IBM Public License Version 1.0

patentability: "it is like talking about what kind of movie we like. setting up criteria, same problem when you start to judge inventions."

well a difference is: one is a law. the other one simply taste.

freedom of action: "ibm is more free to develope their products as they want, without going into negociations."

complains are coming from that people who have problems with their portfolio.

"we like to think the way we handle invention is better that in other companies, we have a program to do that." (there is a comment on that here).

"there is no reason why just hardware and no software, business ideas are more questionable, but just because the databases are not so good and the examiners have problems with it. it´s a question of time."

who ever

has a question for ibm about their patent policy, tell me. i will talk with them at 4pm.

some there are saying, that ibm changed its viewpoint on patents. i even can´t guess, what they mean by that. last year they got even more patents in the us, and they are leading since i don´t know when. contradiction between ibm´s patent policy and open source?

patents, so manny schecter, give ibm freedom of action. one point - and the consequences are ...
